Terms of Service

Last updated: 10 May 2026  ·  Effective: 10 May 2026

1. Provider & Scope

These Terms of Service ("Terms") govern your access to and use of the CertWatchr website and service ("Service") operated by:

CertWatchr
[Street and house number]
[Postcode] [City], Germany
E-mail: office@certwatchr.com

By registering for or using the Service, you accept these Terms in their entirety. If you do not agree, you must not use the Service. These Terms are available at certwatchr.com/terms-of-service and can be saved and reproduced by you at any time.

2. Description of Service

CertWatchr is an SSL/TLS certificate-monitoring service. It periodically connects to the hostnames and ports you register, retrieves certificate metadata, and alerts you when a certificate is approaching expiry or has changed.

The Service is provided in subscription tiers (Free, Starter, Pro). Features and domain limits vary by tier and are described on the pricing page. Monitoring is performed automatically by our systems; we do not manually review the domains or certificates you monitor.

3. Account Registration

You must register an account to use the Service. You agree to:

  • Provide truthful, complete, and up-to-date registration information.
  • Keep your login credentials confidential and not share them with third parties.
  • Notify us immediately at office@certwatchr.com if you suspect unauthorised use of your account.
  • Accept responsibility for all activities carried out under your account.

You must be at least 16 years old to register. We reserve the right to refuse registration or suspend accounts that violate these Terms.

4. User Responsibilities

You are solely responsible for:

  • Ensuring you have the authority or permission to monitor each domain or hostname you register. Do not add third-party domains without the owner's consent.
  • The accuracy of alert configurations (thresholds, e-mail addresses, webhook endpoints).
  • Acting on alerts in a timely manner; CertWatchr provides monitoring information only and does not renew certificates on your behalf.
  • Complying with all applicable laws in your jurisdiction when using the Service.

5. Subscription, Pricing & Billing

Paid subscriptions are billed in advance on a monthly basis via our payment processor Stripe, Inc.. We do not store your payment card details.

  • Prices. All prices are stated in Euro (€). Prices are exclusive of VAT unless stated otherwise. VAT is added at checkout at the rate applicable to your country.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period. You will be notified by e-mail at least 3 days before renewal.
  • Price changes. We will give at least 30 days' notice of any price increase by e-mail before the new price takes effect. Consumers may terminate their subscription before the new price applies. Business users who continue to use the Service accept the new price.
  • Free tier. The free tier has no fixed term and may be modified or discontinued with 30 days' notice.

6. Right of Withdrawal (Consumers Only)

Withdrawal Notice

You have the right to withdraw from this contract within 14 days without giving any reason (§ 355 BGB, implementing EU Directive 2011/83/EU). The withdrawal period begins on the day the contract is concluded (i.e. when your registration is confirmed).

Early commencement of the service: If you request that the Service begins before the withdrawal period expires (which is the case when you start using the Service immediately after registration), you acknowledge — for paid plans — that upon full performance you will lose your right of withdrawal in accordance with § 356 (5) BGB / Art. 16 (m) Consumer Rights Directive. For partially performed services, you remain entitled to a proportionate refund for the unused portion.

Model Withdrawal Form

I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service:

Address of consumer(s):

Signature of consumer(s) (only if this form is notified on paper):

(*) Delete as appropriate.

You may use this form or send any other unambiguous statement to the contact details in Section 1. We will acknowledge receipt without delay and process any refund within 14 days.

7. Cancellation & Refunds

  • Cancellation by you. You may cancel a paid subscription at any time via your account settings or by e-mailing office@certwatchr.com. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
  • Pro-rata refunds. Except where the right of withdrawal applies (see Section 6), monthly subscriptions are non-refundable for the remainder of a billing period. If we terminate your account without cause, we will refund the unused portion pro rata.
  • Termination by us. We may terminate your account for material breach of these Terms (including, but not limited to, non-payment or prohibited activities) after giving you reasonable notice to remedy the breach, unless the breach is incapable of remedy.
  • Account deletion. Upon termination, your domain data will be deleted within 30 days (see Privacy Policy, Section 9).

8. Prohibited Activities

You must not:

  • Use the Service to monitor domains or hosts you do not own or are not authorised to test.
  • Attempt to gain unauthorised access to the Service, our servers, or other users' accounts.
  • Carry out port-scanning, denial-of-service attacks, or other disruptive activities.
  • Circumvent rate limits, domain quotas, or access controls.
  • Introduce malicious code, scripts, or data to the Service.
  • Resell or sublicence the Service without our written permission.
  • Use the Service in a way that violates applicable law, including data-protection law, computer-fraud law, or export regulations.

9. Intellectual Property

The CertWatchr name, logo, software, and all original content are our intellectual property and may not be reproduced, distributed, or used for commercial purposes without our written consent.

You retain all rights to your own data, including domain names and certificate metadata you add to the Service. You grant us a limited, non-exclusive, royalty-free licence to process that data solely to provide the Service.

10. Data & Privacy

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

11. Availability & Changes to Service

We aim for high availability but do not guarantee uninterrupted or error-free access to the Service. Planned maintenance will be announced with reasonable advance notice where possible.

We reserve the right to modify, suspend, or discontinue any part of the Service with 30 days' notice for paid-tier users and 14 days' notice for free-tier users. If we discontinue a paid tier entirely, we will refund any prepaid amounts for periods after discontinuation.

Monitoring alerts depend on network connectivity to the monitored host; we are not liable for missed alerts caused by the host being unreachable, misconfigured, or behind a firewall.

12. Limitation of Liability

The following limitations apply to the fullest extent permitted by applicable law. Mandatory statutory rights of consumers are not affected.

  • We are liable without limitation for damage caused by intent or gross negligence, for injury to life, body, or health, and for claims under product-liability law (§§ 521, 599, 676 BGB; Produkthaftungsgesetz).
  • For simple negligence, we are only liable for breach of a material contractual obligation (Kardinalpflicht) — i.e. an obligation whose fulfilment makes proper performance of the contract possible and on whose compliance you regularly rely. In such cases, liability is limited to foreseeable, contract-typical damage.
  • We are not liable for missed certificate-expiry alerts caused by factors outside our control (e.g. e-mail delivery failures, webhook endpoint unavailability, network outages, or incorrect user configuration), provided we have taken reasonable measures to deliver the alert.
  • Our total aggregate liability per calendar year shall not exceed the greater of: (a) the total fees paid by you for the Service in the 12 months preceding the event giving rise to the claim, or (b) €50.

The above limitations apply to all claims, whether in contract, tort, or otherwise. German law does not permit full exclusion of liability for gross negligence; the above reflects the permissible scope under §§ 305–310 BGB.

13. Indemnification (Business Users Only)

If you use the Service as a business user, you agree to indemnify and hold harmless CertWatchr and its personnel from any third-party claims, damages, and costs (including reasonable legal fees) arising out of your breach of these Terms or your unauthorised use of the Service. This clause does not apply to consumers.

14. Amendments to These Terms

We will notify registered users of material changes to these Terms by e-mail at least 30 days before the new version takes effect. Consumer users who do not agree to the amended Terms may terminate their subscription free of charge before the effective date.

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. Non-material changes (e.g. typographical corrections) may be made without prior notice.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers: The choice of German law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you habitually reside (Art. 6 Rome I Regulation). You may bring legal proceedings in the courts of your place of residence or in Germany.

For business users: Exclusive jurisdiction is the courts of [City of registered office], Germany.

16. Online Dispute Resolution (ODR)

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers who have a complaint about an online purchase: https://ec.europa.eu/consumers/odr

We are not obliged to participate in alternative dispute-resolution procedures and do not currently do so. However, we always endeavour to resolve complaints directly — please contact us first at legal@certwatchr.com.

17. Severability & Entire Agreement

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.

These Terms, together with the Privacy Policy and any applicable Subscription Order, constitute the entire agreement between you and CertWatchr with respect to the Service and supersede all prior agreements or representations.
